1. Acceptance of Terms

By accessing or using MermanDraw ("the service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the service.

2. Description of Service

MermanDraw is a free online Mermaid diagram editor. It allows you to write Mermaid syntax, render diagrams in your browser, export them as PNG or SVG, and create public share links. No account is required.

3. Use of the Service

You may use MermanDraw for any lawful purpose, including personal, commercial, and educational use. You agree not to:

Upload or share content that is illegal, defamatory, infringing, or harmful
Attempt to circumvent rate limits or abuse the sharing or export features
Use the service to distribute malware or malicious content
Reverse engineer, scrape, or systematically extract data from the service
Use automated tools to generate bulk share links

4. Content Ownership

You retain full ownership of any Mermaid code and diagrams you create. By using the share feature, you grant MermanDraw a limited, non-exclusive, royalty-free license to store, reproduce, and serve your content solely for the purpose of operating the service (e.g., displaying your diagram to people who visit your share link).

This license terminates automatically when your diagram is deleted (either by expiry or upon your request).

5. Public Share Links

Share links are public by default. Anyone with the link can view the diagram. Do not share content you want to keep private using the share feature.

Share links for anonymous (non-logged-in) users expire 180 days after the last view. A link that is actively being viewed stays alive automatically. We do not guarantee availability of any share link beyond this policy.

6. Rate Limits

To ensure fair use and protect service availability, the following limits apply per IP address per day:

Share link creation: 20 per day
SVG export: 30 per day

These limits may be adjusted without prior notice.

7. Intellectual Property

MermanDraw is built on Mermaid.js, which is open-source software licensed under the MIT License. The MermanDraw application code, design, and branding are owned by the operator.

8. User Content Responsibility

You are solely responsible for any content you submit, create, or share through the service, including Mermaid code and the diagrams generated from it. You represent and warrant that:

You own or have the right to share the content you submit
Your content does not infringe any third-party intellectual property rights
Your content does not violate any applicable law or regulation
Your content does not contain personal data of others without their consent

MermanDraw does not review, moderate, or verify user-submitted content. We are not responsible for any content shared by users of the service.

9. Third-Party Services

MermanDraw relies on third-party infrastructure and services including Cloudflare (hosting, CDN, database), Google Fonts (typography), jsDelivr (CDN), and Ko-fi/PayPal (optional donations). We have no control over these services and are not responsible for:

Downtime, outages, or data loss caused by third-party providers
Changes to third-party services that affect the availability or functionality of MermanDraw
Privacy practices of third-party services (see our Privacy Policy for details)

10. Disclaimer of Warranties

The service is provided "as is" and "as available" without any warranty of any kind, express or implied. We do not guarantee that the service will be uninterrupted, error-free, or secure, nor that diagrams, share links, or exported files will remain available at any given time. Shared content is preserved subject to the 180-day policy described in Section 5.

We may modify, suspend, or discontinue the service at any time, with or without notice. We recommend keeping your own copies of any diagrams you consider important.

11. Limitation of Liability

To the fullest extent permitted by applicable law, MermanDraw and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of share links, or loss of business opportunities, arising out of or related to your use of the service.

Our total aggregate liability for any claims arising from these terms or your use of the service shall not exceed the amount you have paid us in the twelve months preceding the claim.

These limitations apply regardless of the legal theory under which the claim arises, even if we have been advised of the possibility of such damages.

12. Indemnification

You agree to defend, indemnify, and hold harmless MermanDraw and its operator from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:

Your use of the service
Content you create, share, or distribute through the service
Your violation of these Terms of Service
Your violation of any third-party rights, including intellectual property or privacy rights
Your violation of any applicable law or regulation

13. Termination

We reserve the right to remove any content or restrict access to the service at any time, with or without notice, for any reason, including but not limited to violations of these terms. Termination does not limit any other remedies available to us.

14. Changes to Terms

We may update these terms at any time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the service after changes constitutes your acceptance of the updated terms.

15. Severability

If any provision of these terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

16. Governing Law

These terms are governed by the laws of the Republic of Korea, without regard to conflict of law principles. Any dispute arising from these terms or your use of the service shall be subject to the exclusive jurisdiction of the courts located in the Republic of Korea.
